Public Agreement
This document is a public offer (hereinafter referred to as the "Offer") and contains the terms and conditions for the provision of cloud infrastructure services by OneCloudPlanet.
1. General Provisions
This Agreement is a public offer in accordance with Article 633 of the Civil Code of Ukraine and defines the terms for the provision of cloud infrastructure services. Acceptance of this Offer is registration on the website and/or payment for services.
2. Subject of the Agreement
The Provider undertakes to provide the Customer with cloud infrastructure services in accordance with the selected tariff plan, and the Customer undertakes to pay for these services in the manner and on the terms specified in this Agreement.
3. Procedure for Providing Services
Services are provided 24/7. The Provider ensures service availability of at least 99.9% per calendar month, excluding scheduled maintenance.
4. Cost of Services and Payment Procedure
The cost of services is determined in accordance with the current tariffs posted on the Provider's website. Payment is made on a prepayment basis. The Customer independently chooses the payment method from the available options.
5. Rights and Obligations of the Parties
The Provider undertakes to ensure proper quality of services, timely inform the Customer about changes in tariffs and service conditions. The Customer undertakes to pay for services in a timely manner and comply with the terms of service.
6. Confidentiality and Data Protection
The Provider guarantees the confidentiality of the Customer's data and does not transfer it to third parties without the Customer's written consent, except in cases provided by the legislation of Ukraine.
7. Liability of the Parties
The parties shall be liable for non-performance or improper performance of obligations under this Agreement in accordance with the current legislation of Ukraine.
8. Dispute Resolution
All disputes arising in connection with the performance of this Agreement shall be resolved through negotiations. If an agreement cannot be reached, the dispute shall be referred to the court at the Provider's location.
9. Term of the Agreement
This Agreement comes into force from the moment of acceptance of the Offer by the Customer and remains valid until the parties fully fulfill their obligations. Acceptance is considered to be registration on the Provider's website and/or payment for services.
